2. ACCEPTANCE OF THE TERMS OF USE

Users must read these Terms and Conditions of Use. The use of Sistema Eragilea by the user implies the knowledge and full acceptance of the legal warnings specified below.

The use of certain services offered to the users of Sistema Eragilea may be subject to their own particular conditions that, depending on the case, substitute, complete or modify these terms and conditions. Therefore, prior to using these services, the user must also carefully read and accept the corresponding particular conditions that are applicable.

3. PERSONAL ACCOUNT

Sistema Eragilea is a tool that allows studying the diversity of artist publications in the Basque context, allowing, thus, the charting of the editorial output that takes place in its artistic environment.

The access and use of Sistema Eragilea is free of charge.
The creation of a personal account is necessary to be able to register a publication in Sistema Eragilea.

The “personal account” is the private area of ​​Sistema Eragilea, where registered users (artists, publishers or other rights holders) can: a) describe and catalogue their own publications online; b) make the publications or part of them and related materials available to the public; c) inform about the available stock and how to proceed with the purchase.

The creation of a personal account is required to comply with the following requirements and conditions:

  1. The user must duly fill in the «Sign Up» form. Contact information will never be publicly shared and will be exclusively used to keep the user updated on the status of the publications, as well as to help him/her register them successfully. The user can find additional information on the processing of personal data in our Privacy Policy.
  2. The user agrees to provide truthful, accurate and up-to-date data.
  3. The custody and correct use of the access codes (email and password) is the sole responsibility of the user. Sistema Eragilea will under no circumstances be responsible for the damages generated by unauthorized access by third parties using the user’s access codes.

Once the user has created the personal account, he/she will receive an email to confirm the registration process. Through the account, the user can access to the list of publications, where he/she can manage and view their status at all times.

4. REGISTRATION OF PUBLICATIONS

Sistema Eragilea is a platform that allows artists to describe and catalogue their own publications online. Its database brings together the entries generated by its users and aims to add the publication entries that are already catalogued in other bibliographical sources.

The registering process consists of several steps. Sistema Eragilea allows you to save drafts.

Before an entry is published, Sistema Eragilea will review all the contents of the entry to make sure that all fields have been completed correctly and that the publication agrees with Sistema Eragilea’s cataloguing criteria. When the entry is published, the user receives an informative email.

The registration of a publication is subject to compliance with the following requirements and conditions:

  1. The registered user grants Sistema Eragilea a non-commercial, international, non-exclusive, royalty-free, and non-derivative license to publish on the platform those publications and/or related materials that the user wants to share with the public;
  2. The registered user authorizes the visitors to Sistema Eragilea’s website (www.sistemaeragilea.eus) to view, print, copy or download the publications and any other related content published on the platform and protected by exclusive rights, provided that this is done for the visitor’s personal purposes, without commercial purposes, online distribution or dissemination, and modification, alteration or decompilation of the protected content.
  3. The registered user warrants that he/she is the owner of the necessary exclusive rights over the materials published on the platform or has the authorization of the owner, exonerating Sistema Eragilea from any responsibility in this regard.

We can eliminate the registered publications or any other related material that the registered user has uploaded to Sistema Eragilea if we consider that it violates these conditions of use or the applicable legislation.

5. INDUSTRIAL AND INTELLECTUAL PROPERTY

Contents, texts, photographs, designs, logos, images, sounds, videos, animations, recordings, computer programs, source codes and, in general, any existing intellectual creation in Sistema Eragilea is protected by intellectual property laws. 

Intellectual creations or distinctive signs of third parties that are accessible in Sistema Eragilea are shared without commercial purpose and with the authorization of their legitimate owners. In particular, the authors who have registered their publications in Sistema Eragilea have granted the respective license to make them available to the public.

Sistema Eragilea is the owner of the exclusive rights over the different protectable elements (e.g. publication entries, distinctive signs, graphic design, source code) of the platform, the database consisting of the set of entries generated by the users, and the web as a whole as a multimedia artistic work.

Rights holders can send an email to sistema@sistemaeragilea.eus to notify the existence of any rights over the publications registered on the platform and /or other protected content, as well as errors in them. Sistema Eragilea will make all reasonable efforts to disable access or remove works not authorized by the owners as quickly as possible.

6. PRIVATE USE

Sistema Eragilea’s website visitors (www.sistemaeragilea.eus) are authorized to view, print, copy or download the publications and any other content published on the platform, provided that this is done for the visitor’s personal purposes, without commercial purposes, online distribution or dissemination, and modification, alteration or decompilation of the protected content.

This authorization for personal use does not imply the granting of any license to the user. Any other use will require the express authorization of its legitimate owners.

Likewise, visitors to the website may extract or reuse non-substantial parts of the database consisting of the set of publications registered in Sistema Eragilea, provided that it is done for a non-commercial purpose and does not harm right holders. 

7. LINKS

Sistema Eragilea may contain links to other websites managed by third parties, whose sole purpose is to facilitate access to other sources of information related to the publications registered on the platform. These links do not indicate the existence of any contractual relationship between the owners of these websites and Sistema Eragilea.

8. PRIVACY AND COOKIES

The collection and processing of users’ personal data will be governed by the provisions of our Privacy Policy, which, in general, must be expressly accepted prior to the provision of personal data.

The use of cookies on this website will be governed by our Cookies Policy.

9. DISCLAIMER

Sistema Eragilea does not guarantee that the information contained in the website is accurate, complete or updated and expressly declines any responsibility for errors or omissions in the information contained in the Website.

Sistema Eragilea is exempt from any responsibility derived from the malfunction of the site or any of its services that has its origin in an accidental circumstance, force majeure, necessary maintenance work or any other cause not attributable to the website’s owner.

10. DISCONTINUANCE

Platform duration of Sistema Eragilea’s is indeterminate. However, we reserve the right to suspend or terminate the provision of some or all of its services, without this decision having to be communicated in advance to its users.

11. CHOICE OF LAW

These terms and conditions are governed and construed by Spanish law. The parties agree that any dispute concerning these terms may only brought before the Courts of the city of Bilbao.
